Specific loss and specific loss benefits. In a worker's compensation case, this is that compensation payable for a loss (amputation) or permanent loss of use of members of the body, complete loss of hearing in one or both ears, loss of vision in one or both eyes, and disfigurement This compensation is not intended to compensate a claimant for loss of earning power; rather, it compensates a claimant for the loss of a body part or a particular body function.

Standard of care. In the law of negligence, the degree of care which a reasonable, prudent or careful person should exercise under the same or similar circumstances. If the standard falls below that established by law for the protection of others against unreasonable risk of harm, the person may be liable for damages resulting from such conduct.

Standard of proof or burden of proof. Degree of proof required in a specific kind of case to prevail.

Stare decisis. Policy of the courts to not overturn precedents; adherence to precedents.

Statute . Generally, a law created by a legislature.

Statutory interest. See interest.

Statutory period. The amount of time a person has to file a claim with a court or administrative agency. In workers compensation cases, an injured worker has three years from the date of injury to file a claim petition. If the claim petition is not filed within this statutory period, the injured worker is not entitled to benefits.

Stipulation. Agreement between parties involved in a legal dispute.

Substantive law. The body of law that creates, defines, and regulates rights. Compare with procedural law which prescribes the manner to enforce rights or obtain redress for invasion of rights.

Supplemental agreement. An agreement between an injured worker and the employer or insurer entered into after a notice of compensation payable is issued or after an agreement for compensation has been signed which modifies, suspends, reinstates, or terminates the compensation then being received under the notice of compensation payable or under the original agreement between the parties.

Supreme Court (Pennsylvania). Highest appellate court in Pennsylvania.

Survivor benefits. Workers compensation benefits paid to a surviving dependent of an employee who was fatally injured on the job. Survivor benefits include the payment of weekly compensation and funeral expenses up to $3,000.
