Defective Products Cause Work Injuries

Injuries at work aren't always because of accidents. Injuries are also caused by defects in tools, machines, or other products at your workplace. If you suspect your injury was caused by a product you used at work, you may have a product liability lawsuit in addition to your work comp claim.

Sometime a defective product can cause injuries on the job. Under Pennsylvania's work comp law, a worker is not allowed to sue his or her employer for a work injury. But, if you are hurt by a dangerous product, you are allowed to sue the seller or manufacturer of that product. This is called a "products liability action."

Just because you can't see a defect in a product, doesn't mean it was your fault that you got hurt. If you think there was something wrong with a product you were using, you should call one of our lawyers today.

Our experienced attorneys will:

  • investigate the cause of the accident
  • bring in any necessary experts to examine the product
  • determine the exact cause of your work injury
  • determine if you may have a product liability lawsuit in addition to a claim for work comp

A products liability lawsuit can be filed against the manufacturer, the supplier, distributor, or retailer of the product for:

  • failing to inspect or test the product before placing it on the market
  • creating a flaw in the product
  • failing to discover a flaw in the product
  • failing to discover that the product could be dangerous
  • failing to warn or adequately warn of a risk or hazard associated with the product
  • failing to manufacture and/or install the product correctly
