Types of Pennsylvania Workers Comp Claims

If you are an injured worker, you can request payments by filing one of the following types of PA work comp claims petitions:

  • Loss of Wages claim: Injured workers can receive work comp payments for lost wages due to total or partial disability.
  • Scar claim: Injured workers can receive work comp payments for a work-related scar to the head, face, or neck.
  • Specific Loss claim: Injured workers who lose a body part—or suffer permanent loss of use of a body part—can receive workers compensation payments for the loss.

Once you file a PA work comp claims petition, your case will be reviewed by a judge.

Reinstatement Petitions

Sometimes, your work comp payments may have ended or may have been suspended. If your work-related injury or condition acts up again, you can file a Reinstatement Petition to reopen your work comp claim.

A reinstatement petition generally needs to be filed within 500 weeks—or about 9.5 years—from the date of your last work comp payment.

After you file a reinstatement petition, your case will be reviewed by judge .

Lump Sum Settlement (also called Compromise & Release)

The injured worker or the employer's insurance can request to settle future loss of wage payments for one lump sum of money.

The employer's insurance may also offer to settle your future medical bills for one lump sum of money. This might not be the best option for an injured worker. It is highly recommended that you talk to a lawyer before making this decision.
