Your PA Workmans Comp Claim Hearing

A PA workmans comp judge hears your case.

In a PA workmans comp claim case, there are usually many hearings. A Pennsylvania workers compensation lawyer can guide you through all the rules.

In a claim hearing, there is the "moving party" and the "responding party."

  • The moving party has made the request regarding work comp payments.
  • The responding party is fighting the request made by the moving party.

Examples:

  • You are the moving party when you file a claim petition to request workmans comp payments. Your employer would then be the responding party since they are fighting your request for payments.
  • Your employer is the moving party if they have filed a Petition to Terminate Compensation Benefits. You would then be the responding party since you want to fight their request to stop your PA workmans comp payments.

The attorney for the moving party has witnesses testify under direct examination. The attorney for the responding party can question these witnesses under cross-examination. The entire hearing is recorded by a court reporter.

After the documents and testimony are submitted, the judge will schedule additional hearings.

After all the evidence is submitted and the case is closed, the judge issues a written decision to everyone involved in your case. If someone does not agree with the judge's decision in your case, an appeal can be filed.
